Federal Judges Deal Blow to Pro-Life Efforts: TN Abortion Referral Mandate Upheld

In another example of judicial overreach, the 6th US Circuit Court of Appeals ruled against Tennessee's efforts to protect life, instead siding with the pro-abortion agenda pushed by the Biden Administration.

At issue is Tennessee's refusal to comply with the radical new requirement imposed last year by the US Dept. of Health & Human Services (HHS), forcing family planning clinics accepting taxpayer-funded Title X monies to promote abortion "options." This bold move aimed squarely at circumventing the Volunteer State's long-standing protection of unborn human life.

TN AG Jonathan Skrmetti had sued to block this affront to his state's sovereignty, arguing correctly that Washington bureaucrats shouldn't dictate what medical providers may or may not discuss regarding terminating pregnancies within their borders. In response, the Obama-appointed judges decreed yesterday that the feds can indeed strong-arm local healthcare entities into peddling lethal advice – even when such counsel contravenes existing TN statutes banning most forms of abortion!

This travesty comes despite HHS openly admitting that participating clinics won't actually fund procedures themselves; instead, patients requesting info merely get pointed toward off-site 'providers.' One wonders whether these so-called 'judges' genuinely believe an expectant mother facing a crisis deserves only one-sided guidance.

Monday's decision ensures continued denial of roughly $7.1M annual Title X support intended for almost a hundred predominantly low-income-serving facilities statewide. As a result, vulnerable Tennesseans relying upon those vital resources face diminished access thanks solely to bureaucratic obstinacy driven primarily by ideological fervor.

Meanwhile, PPFA affiliate Ashley Coffield predictably bemoaned the consequences of her organization being denied further public largesse, claiming, "Millions of people across the country rely on essential care — like birth control, STI screenings and treatment, cancer screenings, and other key sexual and reproductive health care services — funded by Title X."
