Arizona Works to Define DUIs with Marijuana

In a landmark decision, Arizona's appellate court has clarified that driving with any amount of THC in one's system does not automatically lead to a DUI charge or license suspension unless impairment can be proven. 

This ruling stems from a case involving a driver, Kirsten, whose license was initially suspended due to the presence of THC metabolites, not for being under the influence at the time of driving. The court's decision to reverse this suspension highlights a significant legal protection for marijuana users, ensuring they are not penalized for past use but rather for current impairment.

The decision not only impacts how law enforcement and courts handle marijuana-related DUIs but also reflects a broader understanding of cannabis's effects compared to alcohol. While alcohol's impairing effects can be more directly correlated with BAC levels, marijuana's active components and metabolites present a more complex situation.
